1. Who We Are
Mogador Estates (“Mogador Estate”, “we”, “us”, “our”) is a curated Moroccan lifestyle house based at 35 Av. de l’Istiqlal, Essaouira, Morocco. We bring together contemporary fine art, ancestral Moroccan Mahia, and Kyff botanical CBD (0% THC) under one roof, and we sell these goods online through mogadorestates.com and in person at our Essaouira atelier.
We are the data controller for the personal data described in this policy. You can reach us about privacy at hans@mogadorestates.com.
We handle personal data in line with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data (and the guidance of the CNDP, the Moroccan data-protection authority). Where we sell to visitors in the European Economic Area or the United Kingdom, we also apply the principles of the GDPR and UK GDPR.
2. The Data We Collect
- Identity & contact data — name, email address, phone number, and delivery/billing address.
- Order & transaction data — products purchased, order value, order history, currency, and delivery preferences.
- Account data — if you create an account, your login details (username and email) and saved addresses.
- Payment data — handled by our payment providers. We receive confirmation of payment (amount, status, and a payment reference) but do not store full card numbers on our servers.
- Communications — messages you send us (contact forms, email, price or reservation enquiries, tasting bookings).
- Technical & usage data — IP address, device and browser type, pages viewed, and approximate location, collected through cookies and analytics (see our Cookie Policy).
- Marketing preferences — your choices about our gazette, launch notices, and private-register communications.
We only collect what we need for the purposes below. We do not knowingly collect more sensitive categories of data.
3. How We Use Your Data
- To process and deliver orders — taking payment, packing and shipping, customs paperwork, and customer support (performance of a contract).
- To manage accounts and requests — private viewings, table-degustation reservations, and enquiries (performance of, or steps toward, a contract).
- To keep in touch — sending gazette dispatches, launch notices, and offers where you have opted in, or where we have a legitimate interest and you have not objected (consent / legitimate interest).
- To run and improve the site — analytics, security, fraud prevention, and fixing faults (legitimate interest).
- To meet legal duties — accounting, tax, consumer-protection, customs, and any lawful request from authorities (legal obligation).
4. Cookies and Similar Technologies
Our site uses cookies and similar technologies for essential functions (such as your shopping cart and security), for analytics, and — where you allow it — for embedded social features. You control non-essential cookies through the consent banner on your first visit. Full detail is in our Cookie Policy.
5. Who We Share Data With
We do not sell your personal data. We share it only with service providers who help us operate, and only as needed:
- Payment providers that process your payment securely.
- Shipping, courier, and customs partners that deliver your order.
- Our brand partner, Kyff, where an order concerns Kyff botanical products.
- Hosting, IT, and analytics providers that keep the site running and secure.
- Professional advisers and authorities where the law requires it.
These providers act under contract and may only use your data for the agreed purpose.
6. International Transfers
We are based in Morocco and ship worldwide, so your data may be processed in countries other than your own, including in the EEA. Where data leaves the EEA or the UK, we rely on appropriate safeguards such as standard contractual clauses, and we take reasonable steps to ensure your data stays protected to the standard described here.
7. How Long We Keep Data
We keep order and financial records for as long as tax and accounting law requires (often up to 10 years in Morocco). Account and marketing data is kept while your account is active or until you unsubscribe or ask us to erase it. We then delete or anonymise it.
8. Your Rights
Subject to applicable law, you may:
- access the personal data we hold about you;
- ask us to correct or complete it;
- ask us to delete it;
- ask us to restrict or stop certain processing;
- receive a portable copy of data you gave us;
- object to direct marketing at any time; and
- withdraw consent where processing is based on consent.
To exercise any right, email hans@mogadorestates.com. We may ask you to verify your identity first. If you are in Morocco and are not satisfied with our response, you may complain to the CNDP (Commission Nationale de contrôle de la protection des Données à caractère Personnel). If you are in the EEA or UK, you may complain to your local supervisory authority.
9. How We Protect Data
We use HTTPS across the site, access controls on our systems, and reputable hosting and payment partners. No method of transmission or storage is perfectly secure, but we take reasonable measures appropriate to the data we hold.
10. Age Restrictions
Our Mahia (spirits) and CBD products are for adults only. We do not knowingly collect data from, or sell these products to, anyone under 18. If you believe a minor has provided us data, contact us and we will remove it.
11. Changes to This Policy
We may update this policy from time to time. The version published here is the one in force, and the “last updated” date below will change when we revise it.
