1. About These Terms
These Terms & Conditions govern your use of mogadorestates.com and any purchase you make through it or at our Essaouira atelier. They form an agreement between you and Mogador Estates (“we”, “us”), of 35 Av. de l’Istiqlal, Essaouira, Morocco. By browsing the site or placing an order you accept these terms.
2. Eligibility and Age
You must be at least 18 years old to purchase our Mahia (spirits) and CBD products, and to hold an account. By ordering, you confirm you meet the legal minimum age for the product in your country and that it is lawful to receive it there. We may refuse or cancel an order where age or legality cannot be confirmed.
3. Products and Descriptions
We sell three disciplines: contemporary fine art (paintings, jewellery, sculpture), Authentic Moroccan Mahia, and Kyff botanical CBD products. We describe items as accurately as we can. Fine art is often unique and handmade, and natural products (spirits, botanicals) can vary slightly in colour, aroma, and finish — such variation is a feature of their origin, not a defect. Availability is limited and may change; listings do not guarantee stock.
4. Prices and Currency
Prices are shown in Moroccan dirham (MAD) unless stated otherwise, and include applicable Moroccan taxes where required. Prices may change at any time before you place an order; the price shown at checkout is the one that applies. International orders may attract import duties and taxes charged by your country, which are your responsibility.
5. Orders and Acceptance
Your order is an offer to buy. We accept it when we confirm dispatch (or, for viewings and reservations, when we confirm your booking). We may decline an order — for example if a product is unavailable, if there is a pricing or description error, or if we are required to by law.
6. Payment
Payment is taken through our secure payment providers. You confirm you are authorised to use the payment method. We do not store full card details. Orders are processed once payment is authorised.
7. Shipping and Delivery
We ship from Morocco and deliver worldwide, subject to the restrictions below. Delivery times are estimates and depend on the destination and customs. Risk passes to you on delivery. Please ensure your address is correct; we are not responsible for loss caused by an incorrect address.
Restricted goods. Mahia is an alcoholic product and Kyff products are CBD-based; we will only dispatch them where it is lawful to do so, to adults, and we may require proof of age or restrict destinations accordingly. We will not ship to any jurisdiction where the product is prohibited.
8. Returns, Cancellations and Refunds
Our returns, cancellation, and refund terms apply in addition to any rights you have under Moroccan consumer law. Please see our Refund and Returns Policy. For hygiene, safety, and legal reasons, opened spirits, opened CBD products, and bespoke or commissioned artworks may not be returnable unless faulty.
9. Mahia — Alcohol Terms
Authentic Moroccan Mahia is a distilled spirit (approximately 40% ABV). It is sold to adults only. You confirm you are of legal drinking age and that importing alcohol into your country is lawful. A signature or proof of age may be required on delivery.
10. Kyff CBD — Product Terms
Kyff products are cultivated under Moroccan Law 13-21 and contain 0% THC. They are offered as lifestyle and wellbeing goods for adults 18+. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Please consult a qualified health professional if you are pregnant, nursing, taking medication, or have a medical condition. Keep out of reach of children.
11. Artwork and Commissions
Original artworks are often unique. Commissions and bespoke pieces may require lead times and a deposit, and cancellation terms for bespoke work are set out at the time of order. Certificates of authenticity are provided where stated. Colours may appear slightly differently on screen than in person.
12. Intellectual Property
All content on this site — text, images, artwork photography, logos, and branding — is owned by Mogador Estates or its partners (including Kyff) and is protected by intellectual-property law. You may not copy, reproduce, or use it commercially without our written permission.
13. Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the site or products. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.
14. Force Majeure
We are not responsible for delay or failure caused by events beyond our reasonable control, including customs delays, strikes, natural events, or transport disruption.
15. Governing Law
These terms are governed by Moroccan law. The courts of Morocco have jurisdiction, without affecting any mandatory consumer rights you have in your country of residence.
